The User of the website (hereinafter referred to as "User") must carefully read and agree to the following terms and conditions, including any future amendments (hereinafter collectively referred to as the "Terms & Conditions") before using the web-site TutorNearby.in. By using the web-site User is automatically accepting the terms & conditions and privacy policy. If you do not agree with any of the terms and conditions of TutorNearby, do not register or use any of its services or features and you will not be authorized to use TutorNearby services.

TutorNearby is an online platform mainly offering a facility to students and tutors to interact each other. The web portal also provides useful services to educational institutes, trainers, professionals, etc of any academic subjects and life skills. In Short, TutorNearby is an online networking community that connects its members for variety of educational services. The registration as a member of TutorNearby or the use of any of the features and services either as a registered member or as a visitor constitutes automatic acceptance of these terms and conditions.

Privacy Policy

The Privacy Policy covers TutorNearby's right to use any personally identifiable information that is collected when you are on the TutorNearby site, and when you use TutorNearby's services. This policy does not apply to the practices of companies that TutorNearby does not own or control or to people that TutorNearby does not employ or manage in writer format. TutorNearby may amend this policy from time to time. Our paid services are subject to change at any given time. We understand that our number one asset is our 'members' and we will never knowingly do anything to harm the trust you have bestowed on us.

• TutorNearby reserves all the rights to update the terms & conditions of this agreement without prior notice to any of its existing or future users/registrants. It is the users' responsibility to periodically review the most current version of this Agreement.
• By accessing or using the website's Content or Services, one agrees to be bound by these Terms of Service. If you do not agree with any of the terms and conditions of TutorNearby, do not register and you will not be authorized to use TutorNearby services.
• Through the use of this site, you agree to hold TutorNearby harmless and its sponsors, owners, shareholders or employees against any claims.
• The users shall not violate any applicable local, provincial, state, national or international law, statute, ordinance, rule or regulation.
• The users shall not upload, post, transmit, publish or distribute any material which infringes, violates, breaches or otherwise contravenes the rights of any third party, including any copyright, trademark, patent, rights of privacy or publicity or any other proprietary right.

The platform allows users to express their views about different schools, institutes, tutors, students and study materials.
• TutorNearby should not be thought of as the authority and the final guide in your decision making for choosing a tutor, institute, study materials, students or any similar services. TutorNearby only interlinks the demands in educational sector between the tutors/institutes/consultants and learners.
• TutorNearby at its sole discretion may edit, delete or block access to any content including Member Posted Content, without notice and without liability. We will however make reasonable efforts to inform the users of the changes.
• Any content of text, image, audio, video, etc. inappropriate to the website will be deleted and removed by our web masters without any prior notice.
• By uploading the logo of your institute, you give TutorNearby the right to use the logo on TutorNearby website as well as on any of our marketing material.
• The users may not make any content item originating from TutorNearby available for public access by any means whatsoever without obtaining prior written permission from TutorNearby.
• The users are responsible for safeguarding the password that you use to access the sites, content and services. You agree not to disclose your password to any third party (any one). You agree to take sole responsibility for any activities or actions under your password.
• TutorNearby reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services with or without notice.
• The user shall not collect screen names, email addresses and postal address or any personal information of members for purposes of advertisement, solicitation or spam.
• The user shall not access or search the site's content or services with any engine, software, or tool.
• The user shall not reformat or frame any portion of the web pages that are part of the TutorNearby Site without a written agreement.
• No individual is permitted to create any fake ID or registration on TutorNearby.
• The settling and payment of tutoring fees will absolutely be decided between the tutor and learner. TutorNearby has no commission from either side. And TNB does not take any responsibility of any type of commitment changes or misbehaviour between the tutors and learners.
• The user registrations fees (if any) and period of validity will be published on the 'Price List' or 'Membership Options' page and shall vary time to time.

Registration

• Some areas of TutorNearby may require you to be or become a registered user or to provide your information details.
• While registering, the users should provide accurate, current and complete information as prompted in the registration forms.
• If a user is a minor (below 18 years of age), he or she is obliged to get prior permission from their parents or guardians for the same and to furnish any credentials like contact numbers, e-mail IDs and addresses.
• If a User acknowledges that any information provided is untrue, inaccurate, not current or incomplete, TutorNearby reserves the whole right to terminate this Agreement and 'user' use of the Site. A user is requested to note his/her application ID & Transactions ID at the time of filling up any application form & making payments. Hereby a user declares that his/her parents or guardians are aware of his/her application to any of the services provided by TutorNearby.
• We use any information voluntarily you give us to enhance your experience in our site, which is to provide you with interactive or personalized elements on the sites and to better prepare future content based on your interests.
• Upon providing his/her information, the User agrees to make his/her contact details available to TutorNearby as to be contacted by for education information and promotions through email, telephone and Short Message Services (SMS), if the User does not wish to be contacted, he/she shall communicate the same to TutorNearby and necessary action shall then be taken.
• TutorNearby uses information to contact you about special and new products from TutorNearby or any of its associate/partner websites.
• TutorNearby reserves the right to use the users mobile and demographic information such as age, gender and location to conduct targeted mobile marketing campaigns even for third parties wishing to advertise using our database.
• TutorNearby also reserves the right to sell this information and also the entire site to a third party if a third party is desirous of purchasing this information. Notwithstanding the users registration with National Do Not Call Registry/ Fully or Partly blocked category under National Customer Preference Register set up under Telecom Regulatory Authority of India (TRAI), the user hereby expresses interest and accords his/her wilful consent to receive communication. The user further confirms that any communication, as mentioned hereinabove, shall not be construed as Unsolicited Commercial Communication under the TRAI rules.

Therefore, your use of TutorNearby is at your own risk to the full extent permissible by applicable law, cyber site disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement. Governing Law and Jurisdiction

The User agrees to submit to the sole jurisdiction and venue for any dispute that may arise under or in relation to the subject matter in Cochin court jurisdiction, Kerala, India only.
